Austin Parking Garage Restraint System Failure Lawsuit Reaches a Settlement

A Multi- Million Dollar lawsuit, reported by KXAN and many other news outlets, like DK Global, concerning a woman whose BMW fell off a seven-story parking garage in downtown Austin when the vehicle restraint system failed has reached a settlement. The incident, which occurred in 2017, was cause for much alarm as a similar incident took place no less than a year prior when another vehicle also went off the 9th story of the same garage. Christi Bowmer’s lawsuit claimed that the garage’s barriers had not been safely and properly repaired and maintained causing her to endure this harrowing experience. Bowmer’s attorney, Sean Breen of Howry, Breen, & Herman, LLP, asserted that the cable system in the garage at the time of the incident violated the building code, the standard of care and was “something in name only.”

Bowmer was going less than a mere nine miles an hour when she accidentally pressed the gas pedal which caused her car to break right through the flimsy and improperly anchored cable barriers. The car then plunged down seven stories and into the alley below right onto another car. Bowmer suffered extensive injuries which required her to undergo three surgeries. Her injuries have greatly impacted her quality of life as she must now live with rods in her back. The lawsuit stated that Bowmer could have very well lost her life.

Sean Breen made the case that a cable barrier should be able to withstand at least double the speed Bowmer was going at the time of the incident. GTT Parking, L.P. and Premier Parking of Tennessee, LLC, failed to construct, repair and maintain the barrier system and needed to remedy this issue before other people suffered as Bowmer had. As a result of the action by Bowmer and HowryBreen, the system has finally been reinforced with concrete, creating a more solid and, hopefully, safe barrier.

The victory of this case was not just for Breen and Bowmer, but also the countless other lives the formerly weak barrier may have cost.
